Do Not Sell My Personal Information.

Last updated: April 24, 2026

1. Your Privacy Rights.

This page is designed to help you understand your privacy rights and to provide a simple way for you to opt out of the sale or sharing of your Personal Information.

The California Privacy Rights Act (CPRA), which amended and expanded the California Consumer Privacy Act (CCPA), grants California residents specific rights regarding their Personal Information — including the right to opt out of the "sale" or "sharing" of their Personal Information with third parties.

While UpNext Software Pvt Ltd does not sell your Personal Information in the traditional sense (i.e., we do not transfer your data to third parties in exchange for money), the broad definitions of "sale" and "sharing" under the CPRA may include certain data practices, such as disclosing your data to third-party advertising platforms for the purpose of serving personalised advertisements (cross-context behavioural advertising).

We respect your rights and are committed to providing you with transparency and control over your Personal Information. This page allows you to exercise your opt-out rights and learn more about our data practices.

If you are not a California resident, you may still benefit from similar rights under other applicable laws. Please see our Privacy Policy for more information about your rights by jurisdiction.

2. What "Sale" of Personal Information Means.

Under the CPRA, "selling" Personal Information means disclosing it to a third party for monetary or other valuable consideration. "Sharing" means disclosing Personal Information to a third party for cross-context behavioural advertising — even if no money changes hands.

UpNext Software does not sell your Personal Information for money. However, we do work with third-party advertising and analytics platforms (such as Google Analytics, Google Ads, and LinkedIn Campaign Manager) that may receive certain information about your interactions with our website and use it to serve targeted advertisements.

To the extent these practices constitute "sharing" under the CPRA, we provide you with the ability to opt out on this page. When you opt out, we will take steps to stop or limit these data disclosures to the extent technically feasible.

Common examples of information that may be involved in such "sharing" include:

  • IP address and general location information.
  • Browser type, device identifiers, and operating system.
  • Pages visited and time spent on our website.
  • Referring URLs and navigation paths.
  • Cookie identifiers and tracking pixel data.

3. Personal Information We Collect.

In the preceding 12 months, UpNext Software has collected the following categories of Personal Information from or about California residents:

  • Identifiers: Name, email address, phone number, IP address, and similar contact details.
  • Commercial Information: Records of services requested or considered, project enquiries, and client communications.
  • Internet or Electronic Network Activity: Browsing history on our website, search queries, page interactions, and referral sources.
  • Geolocation Data: General location data inferred from IP address (city/country level; not precise GPS data).
  • Professional and Employment-Related Information: Job title, company, and career history submitted in job applications.
  • Inferences: Profile data drawn from the above categories to help understand your interests and preferences.

We collect this information directly from you (through forms, emails, and calls), automatically (through cookies and analytics), and from third parties (such as LinkedIn and referral sources).

We do not collect or knowingly share sensitive Personal Information (as defined by CPRA) such as social security numbers, financial account numbers, health data, or biometric data through our website.

4. Our Data Sharing Practices.

We share certain categories of Personal Information with third parties for the business purposes listed below. We do not sell this information for money.

Service Providers (Data Processors): We share Personal Information with companies that help us operate our business — such as web hosting providers, CRM platforms, email services, recruitment tools, and customer support software. These providers are bound by data processing agreements and may only use your data for the specific purposes we instruct.

Analytics Providers: We share website activity data (including IP addresses, device identifiers, and browsing behaviour) with analytics platforms such as Google Analytics to understand how our website is used and improve our services. This data is generally pseudonymised and aggregated.

Advertising Partners: We may share website activity data with advertising platforms (such as Google Ads and LinkedIn) to measure the effectiveness of our campaigns and serve relevant advertisements to users on other platforms. This practice may constitute "sharing" under the CPRA and is subject to your opt-out rights.

Legal and Compliance Disclosures: We may disclose Personal Information to courts, regulators, or law enforcement when required by applicable law.

Business Transfers: In the event of a merger, acquisition, or sale of assets, Personal Information may be transferred as part of that transaction.

In the preceding 12 months, we have not sold Personal Information to any third party for monetary consideration.

6. Your Additional Rights.

In addition to the right to opt out of the sale or sharing of your Personal Information, California residents have the following rights under the CPRA:

Right to Know: You have the right to request that we disclose the categories and specific pieces of Personal Information we have collected about you, the sources from which it was collected, the business or commercial purpose for collecting or sharing it, and the categories of third parties with whom we share it.

Right to Delete: You have the right to request deletion of Personal Information we have collected from you, subject to certain exceptions — including where retention is necessary to complete a transaction, detect security incidents, comply with legal obligations, or exercise free speech rights.

Right to Correct: You have the right to request that we correct inaccurate Personal Information we hold about you, taking into account the nature of the information and the purposes for which we process it.

Right to Limit Use of Sensitive Personal Information: To the extent we process sensitive Personal Information, you have the right to direct us to limit its use and disclosure to only what is necessary to provide our services.

Right to Non-Discrimination: You have the right to receive equal service and pricing from us, and we will not discriminate against you for exercising any of your privacy rights.

To exercise any of these rights, you can submit a request using the form on this page, email us at hello@upnextsoftware.com, or call us at +91 8320352507.

7. Non-Discrimination Policy.

UpNext Software is committed to treating all individuals fairly and without discrimination. We will not discriminate against you for exercising any of your privacy rights under the CPRA or any other applicable privacy law.

Specifically, we will not:

  • Deny you goods or services.
  • Charge you a different price or rate for goods or services.
  • Provide you with a different level or quality of goods or services.
  • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer financial incentives or price differences to the extent permitted by the CPRA where the difference is reasonably related to the value provided by your Personal Information. Any such programmes will be disclosed to you in advance, and participation is entirely voluntary.

8. Authorised Agents.

You may designate an authorised agent to submit a privacy rights request on your behalf. To do so:

  • The authorised agent must provide written proof of authorisation — either a signed permission letter or a Power of Attorney executed in accordance with California Probate Code sections 4000–4465.
  • We may require you to directly verify your own identity and confirm that you have authorised the agent to act on your behalf.
  • We may deny a request from an agent who does not submit proof of authorisation as required.

To submit a request as an authorised agent, please email hello@upnextsoftware.com with the subject line "Authorised Agent Request" and include documentation of your authority to act on behalf of the consumer.

UpNext Software will use commercially reasonable efforts to verify the identity of the consumer and the authorisation of the agent before processing the request. This is done to protect the security of your Personal Information.
